Current Summary of Changes to the Coded Law File

Law File Changes – September 24, 2015
Note: Laws added to the file since the last posting on December 23rd, 2014 begin with relative address/law ordinal 8495. Be aware, however, that changes/corrections have been made to existing laws. A summary is shown below, but may not be complete. We recommend that you overwrite the existing law file with the new one.

With this new posting (and with the more recent ones), a new file format is available to replace the legacy mainframe flat file. The content, however, is based on our Oracle table as the mainframe law table no longer exists due to the decommissioning of our mainframe.

Legislation:

Chapter 490 of the Laws of 2013: Amended Penal Law §175.35, offering a false instrument for filing in the first degree, to designate the existing elements as subdivision one and add a new subdivision two relating to the offering of a false financing statement pursuant to Section 9—502 of the Uniform Commercial Code against the property of a State or local officer or judge or justice in retaliation for the performance of official duties.  This section was effective 11/01/2014.

Correction Law §168-h(3):  Level 3 sex offender or sexual predator fails to personally verify, was added as a class E felony for a first offense and a class D felony for a second or subsequent conviction.

Correction Law §168-k(1):  Sex offender convicted in another jurisdiction fails to notify when establishing a residence in New York State, was added as a class E felony for a first offense and a class D felony for a second or subsequent conviction.

Penal Law §120.05(3) & Penal Law §120.05 (3) Hate Crime: Updated the 30 character law description for Penal Law §120.05(3) and Penal Law §120.05(3) as a hate crime, to make the description more understandable.

Education Law §6513: updated to add the appropriate subdivision.

Parks, Recreation and Historic Preservation Law §25.24(1)(a): snowmobiling while ability impaired by alcohol – first offense,  was updated to reflect that it is NOT a finger-printable offense.
