Overview

New York State enters into Qualified Personal Services Contracts only after considering whether state employees can practicably meet the same needs by providing services of the same or better quality at an equivalent or lower cost. State agencies are required to report information about these contracts to the state task force and on their agencies’ websites. Qualified Personal Services Contracts are any new, renewed, or amended state agency contracts with any non-state entity under state Finance Law §163 or §136-A that were approved on or after Aug. 4, 2008. In addition:

  • the agency believes a majority of the costs of the contract are attributable to compensation of the contractor's personnel; and
  • the agency can reasonably anticipate it will incur costs for the personnel service component of $1 million or more over any 12-month period.
